1. Field of application

Current Conditions of Sales apply to all purchases done by a person buying through the internet site http://www.bali-artisanat.com from the company LIGNES MAUVES. They describe the processes and responsibilities as from the registration of the client on the site up to the delivery. The Buyer (Client) recognizes that he took knowledge and agreed with the present contractual positions before he registered his order.

3. Order

Client registers his orders on site http://www.bali-artisanat.com.

Once the basket and the payment mean are validated on the internet site http://www.bali-artisanat.com, an e-mail is automatically sent to the client to confirm his order; the order is automatically recorded. Validating the order means the full acceptance by the client of the present selling conditions.

Conditions of Sales are subject to modifications. Therefore, the client will be applied the conditions that are effective at the date he registered his order.

4. Price and availability of the goods

Indonesian handicrafts sold by LIGNES MAUVES are offered on the site http://www.bali-artisanat.com, on the day the client visits the site. Client must read carefully the detailed description of the goods before he validates his order. Products ‘offer counts only for available goods (present in stock). Whenever a product would happen being unavailable, client would be advised by mail within 48 hours maximum.

LIGNES MAUVES offers new products, which are guaranteed against defaults when they are delivered. Order is agreed by the client in consideration of the written description of the products. Products’ pictures are illustrations only,  and are not part of the deal.

LIGNES MAUVES indicates net prices, which include VAT, but which do not include transportation costs. If the VAT rate is modified, LIGNES MAUVE can pass the impact of the new rate on the prices. LIGNES MAUVES is authorized to change its sales prices at any time. Client is guaranteed that he will be invoiced with the price that is indicated at the very moment he confirmed his order.

Orders are invoiced in Euros. Invoices are payable in Euros. Possible customs fees or taxes are at client’s pocket for any delivery outside of Metropolitan France.

5. Payment

Purchases are to be paid on line by bank card (Visa, Eurocard / Mastercard or affiliated) on the internet site http://www.bali-artisanat.com. Client is advised he must carefully check his order: products, quantities and final amount.

Client’s payment’ card is debited only when the order is shipped, for an amount that matches with the price and final amount of the products that effectively shipped, including possible transport costs.

Note: LIGNES MAUVES uses the secured on line payment service of the bank CREDIT AGRICOLE. Our company does not keep any bank confidential data that is computed by the client when he confirms payment.  Payment transaction is authenticated by a specific security mean called 3D SECCURE.

[3D SECURE is a secured payment protocol that was developed by Visa to increase the security of e-transactions. Then it was also used by Mastercard. The principle consists in asking the cyber-client a specific question in addition to the number, validity date and validity control pieces of data contained on the bank card. The answer is recorded by client during the first use of 3D Secure. Typical questions are for example: date of birth, Family name of your mother, or any personal piece of information.

6. Transportation costs and delivery

Transportation costs are on client’s charges, except special conditions. Costs depend on the country where goods are shipped, on the weight and dimensions of the goods, on the amount of the order, and on the shipment mean and level of service. LIGNES MAUVES relies on the COLISSIMO service, which is operated by the French post company (LA POSTE). Transportation costs are calculated in respect of the fares provided by LA POSTE; they are passed on the order before the client confirms his purchase.

Our commercial policy may lead us to offer the gratuity of the transportation cost when a minimum amount of order is reached. This is available only for deliveries operated in Metropolitan France, in European Union and Switzerland. (Overseas French deparments and territories, and all other foreign countries : contact us. Delivery will be operated after agreement on transportation costs, and payment of the negociated cost).

Some countries may tax, limit or prohibit the import of specific goods. The client is responsible for checking before he orders that purchased products are licit and authorized in the country where goods are shipped. He also has to pay eventual custom duties when receiving the goods or the invoice. Some custom formalities may impact the delay of delivery. LIGNES MAUVE cannot be considered as responsible for long delays due to custom procedures or taxes.

Transport is operated by LA POSTE – Service name is COLISSIMO. For deliveries In Metropolitan France, and in the French Overseas departments and territories, client can choice eithe simple delivery (in mail box), or delivery against signature. In all other countries, including European Union and Switzerkand, the unique procedure is delivery against signature.

Possible risks related to the transport are supported by the client as from the moment the package containing ordered goods is remitted to LA POSTE by LIGNES MAUVES. When receiving his package, client must check the conditions of the package and of the products; he has to report immediately possible claim on the delivery ticket of the transport company. In case the client is not present to receive the package, a notice is remitted in his mail box by the transporter. This procedure informs the client that the package is available for him for a period of 15 days at the post office (or the transporter office, depending on situations).

Once informed, LIGNES MAUVES sends a reminder mail to the client. After this 15 day period, if the client did not pick the goods, package is returned to LIGNES MAUVES. When goods are returned, return transportation is done on client’s charge, and management fees of 10.00 € + VAT will be invoiced by LIGNES MAUVES.

7. Secured payment transaction

http://www.bali-artisanat.com uses the services of the bank CREDIT AGRICOLE to secure as far as possible the payment transaction. This service integrates the 3D SECURE protocol. When confirming payment, the buyer is directed to a security management  page of the CREDIT AGRICOLE server where he must compute the card number, cryptogram and expiration date pieces of information; et must also answer a predefined question (when using the 3D SECURE service for the firsts time, the client is asked to choose the predefined question). Whatever the amount of the transaction is, a debit authorization is always asked to the client’s bank. The system checks the validity of the card to get a debit authorization. For security reasons, LIGNES MAUVES could ask and identity card copy of buyer.

No bank confidential piece of data is archived on LIGNES MAUVES’ servers.
Confidential bank data is stored only in the CREDIT AGRICOLES system of payment server.

8. Confidential data – Consumers’ protection law

Personal information is collected by LIGNES MAUVES on the site http://www.bali-artisanat.com to enable orders’ processing. In accordance to the French law “Informatique et Libertés” (IT and liberty protection) dated 6^th January 1978, client may always access, and eventually amend or cancel his personal pieces of information. To do so, he must inform by paper mail LIGNES MAUVES, Les trois grenouilles,  Chemin des Abayers, 84400 APT (France) ot by e-mail contact@bali-artisanat.com. He must mention name, physical address and mail address.

To be aware of news, new products or services, Client may receive commercial offers from LIGNES MAUVES or its partners. If Client does not want to receiver such offers any longer, he is just required to de-click the appropriate button in his page of personal data on the site, or he can inform by paper mail LIGNES MAUVES, Les trois grenouilles,  Chemin des Abayers, 84400 APT (France) or by e-mail contact@bali-artisanat.com. He must mention name, physical address and mail address.

Site http://www.bali-artisanat.com is regstred at the CNIL # 1444546 (the French authority for the protection of personal data).

9. Property of products

LIGNES MAUVES remains owner of products as long they are not fully paid by the client. Once the payment is received, the client becomes full owner of the goods et is responsible for all risks during transportation or misuse after reception.

10. Intellectual property

LIGNES MAUVES is the unique owner, together with its partners, of all components (texts, pictures, logos, trade mark, photos) of the site http://www.bali-artisanat.com. In the frame of the French laws concerning the intellectual property, all these elements are protected by creator rights. It is strongly forbidden to use or copy partially or fully any of these elements, except if you are explicitly authorized by LIGNES MAUVES in a written form. Any abuse or misuse is totally forbidden and is subject to prosecution towards intellectual property protection.

11. Responsibilities

LIGNS MAUVES cannot be responsible for pictures and goods descriptions when they are provided by its suppliers.

Offered products comply with current French laws. LIGNES MAUVES cannot be responsible if the goods do not meet legal requirements of the client’s country. LIGENS MAUVES cannot be responsible for a mismanagement of the contract in case of force majeure (strike, flooding, fire …). LIGNES MAUVES is not responsible for the content of other internet sites which could have redirected the client to http://www.bali-artisanat.com. LIGNES MAUVES cannot be responsible to anay loss of data by the buyer, it is his responsibility to make his own backups.

12. Applicable law

All clauses included in the current Conditions of Sales and all sales’ transactions processed on http://www.bali-artisanat.com are rules by French legislative rules. If necessary, the Avignon court in France would be the unique valid court.
